Agreement to Terms

By downloading, installing, or using the Breatho mobile application (the "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

These Terms constitute a legally binding agreement between you and CODEPILOT LIMITED ("Company", "we", "us", or "our") regarding your use of the App.

Description of Service

Breatho is a breathing exercise and wellness application designed to help users practice various breathing techniques for relaxation, focus, sleep improvement, and general well-being. The App provides:

• Guided breathing exercises with visual and audio cues
• Multiple breathing techniques (4-7-8, Box Breathing, Diaphragmatic, etc.)
• Session tracking and progress statistics
• Customizable notifications and reminders
• Premium features for subscribers

Health Disclaimer

Before starting any breathing exercise program, please consider the following:

• Consult with a healthcare professional if you have any respiratory conditions, cardiovascular issues, or other health concerns
• Stop exercising immediately if you experience dizziness, shortness of breath, chest pain, or any discomfort
• The App is not a substitute for professional medical advice, diagnosis, or treatment
• Individual results may vary, and we make no guarantees regarding health outcomes
• Do not use the App while driving or operating machinery

By using the App, you acknowledge that you are voluntarily participating in breathing exercises at your own risk.

User Eligibility

You must be at least 13 years old (or the minimum age in your jurisdiction) to use the App. If you are under 18, you represent that you have obtained parental or guardian consent to use the App.

By using the App, you represent and warrant that:

• You have the legal capacity to enter into these Terms
• You will use the App only for lawful purposes
• You will not attempt to interfere with the proper functioning of the App

User Accounts and Data

The App stores your preferences and usage data locally on your device. You are responsible for:

• Maintaining the security of your device
• All activities that occur under your account
• Backing up your data as needed

We are not responsible for any loss of data resulting from device failure, App deletion, or other circumstances beyond our control.

Subscription Terms

Free Tier

The App offers limited free access with:

• 1 free breathing session per day
• Access to basic breathing techniques
• Basic session tracking

Premium Subscription

Premium subscription unlocks full access to all features:

• Unlimited breathing sessions
• Access to all breathing techniques
• Detailed analytics and insights
• Advanced customization options

Subscription Plans

• Weekly: Billed weekly at the current price
• Yearly: Billed annually at the current price (best value)

Billing and Renewal

• Payment will be charged to your Apple ID account at confirmation of purchase
• Subscription automatically renews unless canceled at least 24 hours before the end of the current period
• Your account will be charged for renewal within 24 hours prior to the end of the current period
• You can manage and cancel your subscription in your App Store account settings
• Any unused portion of a free trial period will be forfeited when purchasing a subscription

Price Changes

We reserve the right to change subscription prices at any time. Price changes will not affect current subscription periods but will apply to subsequent renewals. You will be notified of any price changes in advance.

Refund Policy

All purchases are processed through Apple's App Store. Refund requests must be submitted directly to Apple according to their refund policies. We do not have the ability to process refunds directly.

Intellectual Property

The App and its original content, features, and functionality are owned by CODEPILOT LIMITED and are protected by international copyright, trademark, and other intellectual property laws.

You may not:

• Copy, modify, or distribute the App or its content
• Reverse engineer or attempt to extract source code
• Use the App for commercial purposes without permission
• Remove any copyright or proprietary notices

Acceptable Use

You agree not to:

• Use the App for any unlawful purpose
• Attempt to gain unauthorized access to any part of the App
• Interfere with or disrupt the App's servers or networks
• Transmit any malicious code or harmful content
• Impersonate any person or entity
• Collect or harvest user data without authorization

Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• MERCHANTABILITY
• FITNESS FOR A PARTICULAR PURPOSE
• NON-INFRINGEMENT
• ACCURACY OR RELIABILITY OF CONTENT

We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CODEPILOT LIMITED SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Any loss of profits, data, use, or goodwill
• Any damages resulting from your use or inability to use the App
• Any health issues or injuries arising from breathing exercises

Our total liability shall not exceed the amount you paid for the App in the 12 months preceding the claim.

Indemnification

You agree to indemnify and hold harmless CODEPILOT LIMITED, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any rights of another party

Termination

We may terminate or suspend your access to the App immediately, without prior notice, for any reason, including:

• Breach of these Terms
• Fraudulent or illegal activity
• At our sole discretion

Upon termination, your right to use the App will immediately cease. All provisions of these Terms which should survive termination shall survive.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which CODEPILOT LIMITED is registered, without regard to conflict of law provisions.

Any disputes arising from these Terms or the App shall be resolved through binding arbitration or in the courts of competent jurisdiction.

Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any changes by:

• Posting the updated Terms in the App
• Updating the "Last updated" date
• Sending a notification for material changes

Continued use of the App after changes constitutes acceptance of the new Terms.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and CODEPILOT LIMITED regarding the App and supersede all prior agreements and understandings.
